apply(ies) to use the information designated as the BLOG Collections (the "Information") on the following understandings, terms and conditions. These understandings, terms and conditions apply equally to all or to part of the Information, including any updates or new versions of the Information supplied under this agreement.

Copyright

  1. The Information has been obtained by crawling the Internet. Due to the amount of Information it has not been practicable to obtain permission from copyright owners to provide the Information for the Permitted Uses.
  2. The University of Glasgow understands that all the documents in the Information are documents which have been at some time made publicly available on the Internet and which have been collected using a process which respects the commonly accepted methods (such as robots.txt) for indicating that the documents should not be so collected.
  3. Holders of copyright in individual documents may choose to request deletion of these documents from the Information.
  4. The limitation on permitted use contained in the following section is intended to reduce the risk of any action being brought by copyright owners, but if this happens the Organisation agrees to bear all associated liability.

Permitted Uses

  1. The Information may only be used for research and development of natural-language-processing, information-retrieval or document-understanding systems.
  2. Summaries, analyses and interpretations of the linguistic or other properties of the Information may be derived and published, provided it is not possible to reconstruct the Information from these summaries.
  3. Small excerpts of the Information may be displayed to others or published in a scientific or technical context, solely for the purpose of describing the research and development carried out and related issues.
  4. All efforts must be made not to infringe the rights of any third party including, but not limited to, the authors and publishers of any excerpts used in accordance with clause 3.

Own Assessment of Information Use

The Organisation must make its own assessment of the suitability of the Information for its research and development purposes under Permitted Uses.

Agreement to Delete Data on Request

The Organisation undertakes to delete, or destroy hard copies, within thirty days of receiving notice all copies of any nominated document that is part of the Information whenever requested to do so by any one of:

  1. the University of Glasgow; or
  2. the holder of copyright for the particular document.

Access to the Information by Individuals

The Organisation:

  1. must control access to the Information by individuals and may only grant access to people working under its control, i.e., its own members, consultants to the Organisation, or individuals providing service to the Organisation;
  2. must ensure that before being given access an individual must complete and submit the Individual Application form;
  3. must terminate an Individual's access when the conditions of the application no longer apply;
  4. remains responsible for any breach of the Individual Application form by individuals it grants access to;
  5. will retain the applications of all individuals ever granted access to the Information and make them available upon request to any of the copyright holders and to the University Of Glasgow;
  6. will maintain a list of people with current and recently-terminated access to the Information and make it available to the University Of Glasgow on request; and
  7. Must make sure that an Individual with access only displays the Information to or shares the Information with persons whom his or her Organisation lists as having access to the Information.

Warranty

No Warranty is given by the University of Glasgow in relation to the Collections or there use(s) to which the Collections may be put by the Organisation or the fitness or suitability of those Collections for any particular purpose or under any special conditions regardless of whether any such particular purpose or special conditions are or have been made known to the University of Glasgow prior to, or during, the period of this Agreement. All conditions and warranties, express or implied, whether arising under statute or under common law, including but not limited to conditions and warranties as to quality, merchantability and fitness for purpose are hereby excluded.

 

Acknowledgement

 

The organisation hereby accepts that the both the nature of the material, and the method of collection, is such that the University Of Glasgow can in no way be held responsible for the content of the Information.

 

The organisation further acknowledges that the Information will by its nature contain spam, including, but not limited to, potentially inappropriate, abusive, offensive or unlawful content. The organisation agrees not to hold the University Of Glasgow in any way responsible for any such material contained within the Information.

 

The organisation agrees to protect the University Of Glasgow against any claims or direct losses or expenses arising from or relating to their use of the Information.

Termination

Either party may terminate the Agreement at any time by notifying the other party in writing. On termination, the Organisation must delete all electronic copies of the information, destroy any paper copies, and certify to the University of Glasgow that this has taken place.

Applicable Law

This Agreement is governed by the laws of Scotland.
